1. Purpose and Scope
This Acceptable Use Policy (“AUP”) governs the use of all cloud hosting, web hosting, and related services provided by SkyHost Networks (“Services”). This policy is designed to protect the security, integrity, reliability, and privacy of our network, our infrastructure, and the users of our platform. By utilizing our Services, you agree to comply strictly with this policy. SkyHost Networks reserves the right to modify this AUP at any time, and compliance with revisions is required.
2. Prohibited Content and Material
You may not utilize SkyHost Networks infrastructure to host, stream, link to, or distribute any content that falls into the following categories:
- Child Exploitation: Any material depicting, promoting, or relating to child sexual abuse material (CSAM) or exploitation. Violations will result in immediate termination without refund and referral to law enforcement.
- Infringing Material: Any material that infringes upon copyrights, trademarks, patents, or intellectual property rights of any third party.
- Hate Speech and Violence: Content that incites violence, contains harassing or threatening material, or promotes systemic discrimination, bigotry, or hatred.
- Deceptive Practices: Phishing pages, fraud networks, pyramid schemes, or sites disguised to steal financial or personal login credentials.
- Defamatory Content: Material that is unlawfully libelous, defamatory, or violates personal privacy rights.
3. System and Network Resource Abuse
SkyHost Networks utilizes high-performance shared and reseller cloud infrastructure. To ensure optimal performance, stability, and speed for all users, individual accounts must not consume an unfair or excessive amount of server resources.
"Excessive resource consumption" includes, but is not limited to, any activity that creates an abnormal load on server processors (CPU), memory (RAM), disk input/output (I/O), or network interfaces. This includes poorly optimized databases, un-cached high-traffic sites, custom scripts, or cron jobs that run too frequently.
If an account is found to be negatively impacting server performance or threatening the stability of other users, SkyHost Networks reserves the right to take immediate action without prior notice. Actions may include killing offending processes, temporarily throttling account resources, or suspending the account completely. SkyHost Networks will make a reasonable effort to notify the client after taking action to help resolve the underlying technical issue, but our primary responsibility is maintaining network uptime and server stability.
4. High-Risk Technical Prohibitions
The following activities carry extreme infrastructure risk and are strictly prohibited on SkyHost Networks servers:
- Cryptomining: Running scripts or software meant to mine digital currencies (Bitcoin, Monero, etc.).
- Abusive Networks: Hosting Tor nodes, open proxies, IRC bots, torrent trackers, or public file-sharing networks.
- Malware Distribution: Hosting or distributing viruses, worms, Trojan horses, rootkits, or password crackers.
- Security Scanning: Running network scanners, port mappers, or vulnerability assessment tools from our nodes without explicit prior written authorization.
5. Email, Mass Mailings, and Spam Policy
SkyHost Networks maintains a zero-tolerance policy for unsolicited bulk email ("Spam").
- Bulk Email Banned: You may not use our standard hosting plans or mail queues to transmit mass marketing emails, newsletters, or transactional blasts. All marketing communications must be routed through external, dedicated SMTP providers.
- CAN-SPAM Compliance: All outbound mail must comply with the US CAN-SPAM Act of 2003.
- IP Blacklisting: If a client's mailing habits result in our server IP addresses getting flagged on RBLs (Real-time Blackhole Lists) or spam databases, the customer account will be suspended immediately and charged a standard IP cleanup fee.
6. Security and Account Responsibility
Customers are solely responsible for updating and maintaining the software running on their accounts (such as WordPress cores, plugins, themes, and custom scripts).
- Compromised Accounts: If an account is breached due to weak passwords or outdated software, and begins sending outbound spam or launching DDoS attacks, SkyHost Networks will suspend the account immediately to protect the network.
- Reactivation: Compromised accounts will only be reactivated once the client proves the security vulnerabilities have been completely patched.
7. Enforcement and Right of Termination
SkyHost Networks is the sole arbiter of what constitutes a violation of this AUP. We reserve the right to suspend or terminate any user account at our sole discretion, without warning or prior notification, if an ongoing violation threatens the operational status of our infrastructure. No refunds will be issued for accounts terminated due to AUP violations.
